1. Definitions

  • Company Users: Registered businesses participating in reverse auctions, subject to an annual subscription fee.
  • Individual Users: Members of the general public participating in traditional auctions, subject to scaled percentage fees.
  • Subscription Fee: The annual fee paid by Company Users for access to reverse auction features.
  • Scaled Percentage Fees: Transaction fees charged to Individual Users based on a percentage of the final sale price in traditional auctions.
  • Service: Access to and use of our e-auction platform, including both traditional and reverse auctions.

2. Refund Policy for Company Users (Annual Subscription Fee)

2.1. Eligibility for Refunds

  •  14-Day Cooling-Off Period: Company Users are eligible for a full refund of the annual subscription fee if they cancel their subscription within 14 calendar days of the initial purchase date.

Conditions:

  • No substantial use of the Service has occurred (e.g., posting projects, accepting bids).
  • The refund request is made in writing to our Customer Support team within the 14-day period.

2.2. Non-Refundable Circumstances

  •  Refunds will not be issued if:
    • The 14-day cooling-off period has expired.
    • The Company User has substantially used the Service (e.g., posted one or more projects).
    • The account was terminated due to a violation of our Terms of Service or other policies

2.3. Automatic Renewal

  • Annual subscriptions are set to renew automatically at the end of each billing cycle.
  • Cancellation of Automatic Renewal:
    • Company Users may disable automatic renewal at any time through their Account Settings.
    • To avoid being charged for the next billing cycle, cancellation must occur at least 7 days before the renewal date.
  • Refunds for Renewals:
    • Refunds for automatically renewed subscriptions are subject to the same 14-day cooling-off period and conditions as initial subscriptions.

3. Refund Policy for Individual Users (Scaled Percentage Fees)

3.1. Nature of Fees

  • Scaled percentage fees are charged upon the successful completion of a transaction in traditional auctions.
  • These fees are deducted automatically from the final sale price.

3.2. Non-Refundable Fees

  • Transaction Fees: All scaled percentage fees are non-refundable once a transaction is completed.
  • Listing Fees: Any fees associated with listing an item for auction are non-refundable, regardless of the auction outcome.

3.3. Exceptions

  • If a transaction is canceled due to a fault in our Service, we may, at our discretion, refund
    the scaled percentage fee.
  • Requests for such refunds must be submitted within 14 days of the transaction date.


4. Cancellation Policy

4.1. Cancellation by Company Users

  • During the Cooling-Off Period:
    • Company Users may cancel their subscription within 14 days of purchase for a full refund, provided the Service has not been substantially used.
  • After the Cooling-Off Period:
    • Subscriptions can be canceled at any time through Account Settings.
    • No refunds will be issued for cancellations made after the cooling-off period.
    •  Access to subscription benefits will continue until the end of the current billing cycle.

4.2. Cancellation by Individual Users

  •  Individual Users may deactivate their accounts at any time through Account Settings.
  • Deactivating an account does not entitle the user to any refunds of fees already incurred.


4.3. Cancellation by Us

  • We reserve the right to suspend or terminate accounts in accordance with our Terms of
    Service.
  • Refunds:
    • If we terminate a Company User’s account without cause, a prorated refund of the subscription fee may be issued.
    • No refunds will be provided if termination is due to a violation of our policies.

 


5. Process for Requesting a Refund

5.1. Submission

5.2. Review

  • Our team will review your request and may ask for additional information.
  • Processing time is typically within 7-14 business days.

  • Approved Refunds:
    • Refunds will be issued to the original payment method.
    • Allow up to 10 business days for the refund to reflect in your account, depending on your financial institution.
  • Denied Refunds:
    • If the refund request is denied, we will provide a written explanation via email.

6. Exceptions and Non-Refundable Services

  • Digital Goods and Services: Any digital goods or premium features purchased are non-refundable once accessed or downloaded.
  • Promotional Offers: Fees paid for services purchased during promotional periods or with discount codes may be non-refundable, subject to the terms of the promotion.
  • Third-Party Services: We are not responsible for refunding any fees paid to third-party service providers accessed through our platform.

7. Chargebacks

  •  Initiating a chargeback without first contacting us to resolve the issue may result in the suspension or termination of your account.
  • Any fees associated with wrongful chargebacks may be charged back to the user.
